The SAFE Banking Act has passed the US House of Representatives by a vote of 321 to 103! SAFE Banking Act, originally a marijuana-only bill, was amended to encourage U.S. banks and credit card companies to do business with hemp and CBD companies. Specifically, the bill:
Provides a safe harbor for hemp financial transactions, ensuring that banks and other financial institutions would not face federal punishment for those activities; and Directs the federal financial regulators (FDIC, Federal Reserve, etc.) to issue clear, formal guidance to banks, credit card companies and other financial institutions about the legality of hemp and CBD commerce.

HEMP NEWS FROM OHIO – SENATE BILL 57 PASSES
Today, Governor Mike DeWine of Ohio signed Senate Bill 57 into law, surrounded by supporters, including the U.S. Hemp Roundtable’s lobbying team. The passing of this bill means that retail sale of hemp-derived CBD is now legal, ending months of product seizures and embargoes. In addition, it alleviates confusion and hopes to eliminate enforcement actions against retailers, while also clarifying that hemp is separate and distinct from marijuana in Ohio by adding new definitions of hemp and hemp products to the law.
The rule-making process for growers and processors is still in the works and will continue to be built out over the next several months to determine best practices in light of the bill passing. However, in the meantime, an emergency clause contained in the bill means the retail sale of hemp products can occur immediately.
For further information and instruction on the state of hemp in Ohio, the Department of Agriculture has posted new guidance on hemp and CBD in Ohio. Additionally, the State of Ohio Board of Pharmacy also released a statement on the new guidance.

Iowa: MIXED NEWS FROM IOWA– Yesterday, Governor Kim Reynolds signed Senate File 599, making Iowa the 43rdstate to authorize a hemp growing program. The Roundtable’s lobbyists were able to introduce into a once-restrictive bill protections from the Roundtable’s Model State Act for hemp-derived CBD products. The House floor leader, listening closely to Roundtable representatives, made clear on video here that this bill was intended to make retail sale of hemp-derived CBD legal.
Unfortunately, yesterday, Governor Reynolds issued a contradictory statement, arguing that the bill does NOT legalize the retail sale of CBD, that federal law controls, and that the FDA has declared that CBD is not a dietary supplement. Regular readers of this space know that the Roundtable strongly disagrees with this assessment – in our informed opinion, the FDA’s guidance is inaccurate, and it is neither final, nor legally binding. However, we anticipate a continued battle in the Hawkeye State. Hemp Supporters, please stay tuned for our next strategy.

Iowa: After a local county attorney announced a March crackdown on CBD products, Senate File 599 was introduced that would bring Iowa into hemp growing and provides protections from the Roundtable’s Model State Act for hemp-derived CBD products. Initial language that required retail products to comply with the Food Drug & Cosmetics Act was modified to only require a vaguer compliance with federal law. The House floor leader, listening closely to Roundtable representatives, made clear on video here that this bill was intended to make retail sale of hemp-derived CBD legal. Senate File 599 passed the House on 4/24 with only one no vote and the Senate on 4/25 with only one no vote. On to the Governor’s desk!

Ohio Update: The passage of SB57 will make hemp and the retail sale of hemp derived CBD legal!
SB57 Passed the Senate on 3-28-19. SB57 was sent to the House on 3-29-19 and is currently sitting in Committee as of 4-2 with the most recent hearing 4-9.

The FDA has scheduled a public hearing on May 31 Silver Spring, Maryland from 8 a.m. to 6 p.m. to explore issues around products containing cannabis or cannabis-derived compounds such as cannabidiol (CBD).
FDA is establishing a docket for public comment on this hearing. The docket number is FDA-2019-N-1482. The docket will close on July 2, 2019. Submit either electronic or written comments on this public hearing by July 2, 2019. Please note that late, untimely filed comments will not be considered. Electronic comments must be submitted on or before July 2, 2019. The https://www.regulations.gov electronic filing system will accept comments until 11:59 p.m. Eastern Time at the end of July 2, 2019. Comments received by mail/hand delivery/courier (for written/paper submissions) will be considered timely if they are postmarked or the delivery service acceptance receipt is on or before that date.
